Recent projects: Lexonomics has provided economic advice to parties during several recent phase II merger proceedings before the Dutch competition authority, including Cehave/Agrifirm, Connexxion/Veolia and Eureko/De Friesland. All transactions have been unconditionally cleared. Lexonomics has assessed rebate schemes for parties in various sectors, among others as part of their self-assessment and compliance programmes, and in civil court proceedings. Lexonomics has assisted Dutch telecoms regulator OPTA in various market analysis project, ranging from unbundled local loop access wholesale services (ULL) to cable networks. Lexonomics is assisting parties in various cartel damages cases, working in some cases for the defendants and in some cases for claimants. Lexonomics has supported the Dutch Healthcare authority (NZa) in preparing its position paper (in Dutch) on the financing of disease management initiatives in the Netherlands. For Royal Philips Electronics, Lexonomics carried out quantitative economic analyses to define the relevant market for coffee machines and to assess potential conglomerate effects. This was part of the procedure before the European Commission to asses the takeover of Saeco International Group by Philips (M.5547). For BOGIN (Association of the Dutch Generic Medicines Industry), Lexonomics has carried out an analysis of the competitive effects of collective and individual preference policy by health insurers in the Netherlands. Lexonomics has advised OPTA regarding the joint venture between KPN and Reggefiber (NMa press release). As part of an internal compliance programme, Lexonomics has carried out an analysis of the economic effects of a rebate scheme used by a large European company. Lexonomics has assisted Royal Philips Electronics in a number of acquisition projects. For KPN Lexonomics has analysed the competitive position of KPN's television broadcast retail services. Lexonomics has carried out a background study for the Dutch Scientific Council for Government Policy (WRR) into the relationship between regulation and investments in infrastructure. For the Dutch telecoms authority (OPTA), Lexonomics has carried out an analysis of the possible effects of countervailing buyer power on the tariffs set by network operators for fixed terminating access services. For the Dutch telecoms authority (OPTA), Lexonomics has carried out an analysis of the pricing pressure experienced by cable operators in the supply of retail television services (see here the link to the report). During an in-depth investigation by the NMa in the licensing phase (equivalent to the EU Commission’s phase II), Lexonomics has provided economic advice on market definition and dominance issues to CSM sugar and Royal Cosun. The NMa cleared the merger without any remedies. Lexonomics has advised public transport company Connexxion during its take-over of GVU and Novio. In a bidding analysis Lexonomics has analysed all tenders of public bus transport concessions over the past 5 years. The NMa cleared both take-overs without any remedies. Lexonomics has carried out a “self-assessment” under the Horizontal Agreement Guidelines for a Dutch buyer group. Lexonomics has assisted Dutch telecoms and post regulator OPTA during the completion of the 2006 fixed telephony market analysis decisions. Lexonomics has advised a group of electricity producers in Hungary during an in-depth investigation by the EU Commission into alleged State Aid. For a number of traders Lexonomics has carried out an economic analysis of the competitive effects of the “Supplier of Choice” distribution system by De Beers related to an in-depth investigation by the EU Commission.
