On 6 May 2010 the Dutch Competition authority NMa unconditionally approved the merger between Agrifirm and Cehave. Lexonomics gave economic advice to the parties during the licensing phase (NMa decision, in Dutch). On 16 February 2010 the Dutch Trade and Industry Appeals Tribunal (CBb) published its decision upholding the 2008 market analysis decision regarding fixed terminating access services by the Dutch telecommunications regulator OPTA (decision in Dutch). Lexonomics carried out a study on countervailing buyer power (in Dutch) for OPTA that is central in this decision. On 26 January 2010 DG Competition of the European Commission organised an expert workshop on the quantification of damages as a result of competition law infringements. The various contributions, including a contribution by Theon van Dijk (together with Frank Verboven), can be found on DG Competition's website. On 27 July 2009 the European Commission unconditionally approved the takeover of Saeco International Group by Royal Philips Electronics (M.5547). Lexonomics carried out a quantitative economic analysis for Philips in the area of market definition and conglomerate effects. On 29 May 2009 the Committee on Vertical Integration adviced the Minister of Health, Welfare and Sport on the question whether a prohibition of vertical integration between health insurance companies and suppliers of healthservices is "necessary" and "proportional". On 6 February 2009 Theon van Dijk gave a presentation at the University of Tilburg on the role of efficiency improvements in the competitive assessment of mergers ("Efficiency Improvements in Merger Control" in Dutch). On 10 January 2009 Belgian newspaper De Tijd published an opinion on the effects of regulation on broadband penetration ("Wakker concurrentie aan op de breedbandmarkt"). This opinion is based on the study "Regulation and broadband penetration - What is required to regain speed?"). On 28 November 2008 Theon van Dijk gave a presentation on regulation and international broadband penetration at the first annual conference on "Competition and Regulation in Network Industries", which was held at the Center for European Policy Studies (CEPS) in Brussels ("Regulation and Broadband Penetration"). On 6 August 2008 the American Bar Association published the three-volume book "Issues in Competition Law and Policy". Together with Frank Verboven, Theon van Dijk wrote a chapter on the quantification of economic damages in the third volume of this book ("Issues in Competition Law and Policy"). On 28 February 2008 Theon van Dijk gave a presentation in Utrecht at a workshop on efficiency gains from mergers, organised by the Dutch Healthcare authority ("Wanted: efficiency defence (not dead but alive)"). Together with Freshfields Amsterdam, Lexonomics carried out a study for the Dutch Healthcare Authority (NZa) on the definition of geographic markets for hospitals in the Netherlands. On 27 and 28 November 2007 Lexonomics gave presentations on mergers in the cure and the care sector as part of the 3-days course "Health care and the NMa" that was organised by the "Studiecentrum voor Bedrijf en Overheid". On 11 October Theon van Dijk gave a presentation on the draft EC guidelines on non-horizontal mergers at the 5th annual conference Competition Law Developments 2007 ("Ontwikkelingen Mededingingsrecht 2007"). As from September 2007, Jonas Rosenstok works together with Lexonomics on regulation and competition cases. Jonas worked for almost 3 years with the Dutch telecoms regulator OPTA, where he was a member of the Economic Analysis Team and where he specialised in the broadcast sector. Together with Frank Verboven, Theon van Dijk has written a commentary on the private enforcement of EC competition rules for Vox, a "policy portal featuring research-based analysis and commentary from Europe's leading economists" ("Designing the rules for private enforcement of EC competition law"). After an in-depth investigation in the licensing phase, on 20 April 2007 the NMa cleared without remedies the acquisition of CSM sugar by Royal Cosun. Lexonomics provided economic advise to both parties. On 17 April 2007, Theon van Dijk gave a presentation at the 6th Markt & Mededinging conference in The Hague. Topic of his presentation was “Mergers in Regulated Sectors”. On 16 March 2007, Theon van Dijk gave a presentation at the ACLE Workshop on Strategic Firm-Authority Interaction in Antitrust, Merger Control and Regulation. Title of his presentation was "Banning price discrimination by dominant firms". On 15 March 2007, the Dutch Association of Competition Law organised a meeting at which professor Stephen Calkins (Wayne State University Law School) held a presentation on the relation between US en EU competition law. In December 2006, the NMa cleared the acquisitions of GVU and Novio by public transport company Connexxion. Despite a high combined market share, the NMa concluded these acquisitions did not raise competitive concerns because a bidding analysis showed these parties were not Connexxion’s closest competitors. Lexonomics carried out the bidding analysis for Connexxion.
